We may act for clients wishing to adjudicate a construction dispute on a “No Win No Fee” basis.

Each case is different so before we agree to act on a No Win No Fee basis, we will undertake a review of your claim to understand whether such an arrangement is suitable. We will agree our fee for this review with you before starting our work.

In the event that we are prepared to work on a No Win No Fee basis, a Conditional Fee Agreement will be drawn up. Under this arrangement, we agree to receive no payment if the case is lost but will receive our normal fees or a higher than normal payment if the case is successful. The uplift in our fees will be agreed with you in the Conditional Fee Agreement.

While a No Win No Fee arrangement reduces the upfront cost of running an adjudication, you will still be responsible for the adjudicator’s fees and expenses in the event of an unsuccessful claim, together with the costs of any disbursements necessary to pursue the claim.

To cover the adjudicator’s fees and expenses and any disbursements incurred, you may wish to obtain After The Event Insurance. If we consider the claim is worth pursuing on a No Win No Fee basis, we will refer the matter to Acasta European Insurance Company Limited, who may decide to offer you cover. Insurance may also be available from alternative providers.

Unless replaced by a Conditional Fee Agreement, our standard terms of engagement apply, a copy of which will be provided on our engagement.
